Terms of Business
These Terms of Business apply to client employers engaging Rutledge Group for the introduction or supply of work-seekers in Northern Ireland.
Definitions
"Client" means the employer engaging Rutledge. "Candidate" means a work-seeker introduced by Rutledge. "Engagement" means the employment, hire or use of a Candidate by the Client whether on a permanent, temporary or contract basis.
Conduct Regulations
Rutledge complies with the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (as applied in Northern Ireland) and operates as both an Employment Agency (for permanent placements) and an Employment Business (for temporary placements).
Permanent Placements
Introduction fees for permanent placements are payable on the Candidate accepting an offer and are based on a percentage of the Candidate's first-year gross remuneration. The exact percentage is set out in the Client's individual fee agreement.
Temporary Placements
Hourly charge rates apply for temporary placements and include the Candidate's pay, employer's National Insurance, holiday pay, pension auto-enrolment contributions and Rutledge's margin. Timesheets must be approved weekly.
Refunds & Replacements
A sliding-scale rebate or replacement is available where a permanent Candidate leaves within the first 12 weeks for reasons unrelated to redundancy or restructure, subject to fees being paid in full and notice being given within 7 days of the Candidate leaving.
Right to Work & Compliance
Rutledge undertakes Right to Work, identity and (where appropriate) Access NI and NISCC checks before introducing Candidates. The Client retains responsibility for satisfying itself as to the suitability of any Candidate engaged.
Liability
Rutledge's liability for any claim is limited to the fees paid in respect of the relevant Engagement during the 12 months preceding the claim, save where liability cannot lawfully be excluded.
Governing Law
These Terms are governed by the laws of Northern Ireland and subject to the exclusive jurisdiction of the Northern Ireland courts.
